Please read these Terms & Conditions ("Terms") carefully before using cookchook.com and any associated services operated by CookChook ("we", "our", or "us"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

1. Acceptance of Terms

By creating an account, accessing, or using CookChook, you confirm that you are at least 13 years of age (or the minimum age in your jurisdiction), that you have the legal capacity to enter into these Terms, and that you agree to be bound by them. If you are using CookChook on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Services

CookChook provides:

  • A weekly meal planner with macro tracking
  • An ingredient substitute finder
  • Food storage time lookup (can-you-freeze, shelf life)
  • A calorie and nutrition lookup tool powered by the USDA FoodData Central database
  • An ingredient translator
  • Recipe discovery and cooking techniques guides
  • A Pro subscription with additional features

Nutritional and calorie data is provided for informational purposes only and should not replace advice from a qualified nutritionist, dietitian, or medical professional.

3. Accounts and Registration

  • You must create an account to access certain features (meal planner, macro tracker, goals).
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must provide accurate and complete information during registration.
  • You must notify us immediately of any unauthorised use of your account at support@cookchook.com.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free and Pro Plans

CookChook offers a free plan and a Pro subscription.

  • The free plan provides access to core cooking tools and a limited meal planning experience.
  • The Pro plan unlocks additional features as described on the Pricing page.
  • Pro plan pricing, billing period, and included features are subject to change. We will provide reasonable notice of material changes.
  • Payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis until you cancel.
  • You may cancel your Pro subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued unless required by applicable law.

5. Refund Policy

Subscription fees are generally non-refundable. Where required by applicable consumer protection laws (such as Australian Consumer Law or EU consumer rights directives), you may be entitled to a refund. To request a refund, contact us at support@cookchook.com within 14 days of your initial purchase.

6. Acceptable Use

You agree not to:

  • Use our services in any way that violates applicable laws or regulations
  • Attempt to gain unauthorised access to our systems, databases, or other users' accounts
  • Scrape, crawl, or systematically download content from CookChook without written permission
  • Use automated bots or tools to interact with our services in a way that causes undue load
  • Upload or transmit viruses, malware, or other harmful code
  • Use our services to send unsolicited communications or spam
  • Reproduce, redistribute, or create derivative works from our proprietary content without permission
  • Misuse the feedback or reporting systems

7. Intellectual Property

All content on CookChook — including text, graphics, logos, icons, data compilations, and software — is the property of CookChook or its content suppliers and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to access and use our services for your personal, non-commercial use. This licence does not include the right to:

  • Resell or commercially exploit any part of our services or content
  • Modify or create derivative works
  • Download or copy account information for the benefit of another service

Content you create (meal plans, personal goals, notes) remains yours. By saving it on CookChook, you grant us a limited licence to store and display it back to you.

8. Nutritional Information Disclaimer

Nutritional data provided through CookChook (including calorie counts, macro breakdowns, and ingredient information) is sourced from third-party databases including the USDA FoodData Central database and the Spoonacular API. This data is provided for general informational purposes only.

CookChook makes no warranties about the accuracy, completeness, or suitability of nutritional information for any specific dietary, medical, or health purpose. Always consult a qualified nutrition or medical professional before making significant dietary changes.

9. Limitation of Liability

To the fullest extent permitted by law, CookChook shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services. This includes but is not limited to loss of data, loss of profits, or personal injury resulting from reliance on nutritional information.

Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to CookChook in the 12 months prior to the event giving rise to the claim, or AUD $100, whichever is greater.

Nothing in these Terms limits liability which cannot be excluded under applicable law, including under the Australian Consumer Law.

10. Indemnification

You agree to indemnify and hold harmless CookChook, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

11. Third-Party Services

Our services integrate with third-party providers including Clerk (authentication), Stripe (payments), Vercel (hosting), Supabase (database), Google Analytics, and the Spoonacular and USDA APIs. Your use of these integrations is subject to each provider's own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

12. Service Availability and Changes

We aim to keep CookChook available 24/7 but do not guarantee uninterrupted access. We reserve the right to:

  • Modify, suspend, or discontinue any feature or the entire service at any time
  • Perform maintenance that may cause temporary downtime
  • Change API providers or data sources

We will endeavour to provide reasonable notice of significant changes.

13. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia. If you are a consumer in the European Union, you may also benefit from mandatory consumer protection provisions in your country.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email (if you have an account) or a notice on our website. Continued use after the effective date of revised Terms constitutes acceptance of the changes. If you do not agree to the updated Terms, you should stop using our services and delete your account.
